GeoHot v Sony è più che un processo

Carissimi appassionati di tecnologia, oggi ho ricevuto su Twitter (mio e di unico_lab) un link ad un articolo pubblicato sul sito dell'Electronic Frontier Foundation circa il processo che a giorni verrà coinvolto l'hacker George GeoHot Hotz contro il colosso multinazionale Sony. L'articolo integrale lo trovate a questo indirizzo, ma se mi permettete vorrei riportarvi qui di seguito il passaggio che ritengo più significativo con la relativa (non letterale) traduzione.

Not content with the DMCA hammer, Sony is also bringing a slew of outrageous Computer Fraud and Abuse Act claims. The basic gist of Sony's argument is that the researchers accessed their own PlayStation 3 consoles in a way that violated the agreement that Sony imposes on users of its network (and supposedly enabled others to do the same). But the researchers don't seem to have used Sony's network in their research — they just used the consoles they bought with their own money. Simply put, Sony claims that it's illegal for users to access their own computers in a way that Sony doesn't like. Moreover, because the CFAA has criminal as well as civil penalties, Sony is actually saying that it's a crime for users to access their own computers in a way that Sony doesn't like.

That means Sony is sending another dangerous message: that it has rights in the computer it sells you even after you buy it, and therefore can decide whether your tinkering with that computer is legal or not. We disagree. Once you buy a computer, it's yours. It shouldn't be a crime for you to access your own computer, regardless of whether Sony or any other company likes what you're doing.

Non ancora soddisfatta della scure del DCMA, Sony porta a supporto del castello accusatorio anche un pletora di rivendicazioni circa la legge sugli abusi e le frodi informatiche. L'idea di base dell'accusa di Sony è che il gruppo di ricercatori hanno avuto accesso alle loro PS3 in un modo che violi di fatto l'accordo d'uso che l'utente accetta quando accede alla rete di Sony (PSN). Ma, stando a quanto riportato dai ricercatori, loro sono giunti alle loro scoperte senza accedere a PSN, ma semplicemente utilizzando le console che hanno acquistato regolarmente pagandole con soldi veri. Inoltre, visto la legge sulle frodi informatiche ha anche risvolti penali, Sony vorrebbe affermare che è un crimine che gli utenti utilizzino i propri computer in modo che al produttore non piace.

Questo significa che Sony sta inviando un altro pericoloso messaggio: ovvero che detiene diritti sui computer che vende anche dopo che sono stati acquistati e, di conseguenza, possono decidere se quello che l'utente fa con quel computer è legale o meno. Non siamo d'accordo. Una volta che hai comprato un computer, è tuo. Non dovrebbe essere un reato utilizzarlo indipendentemente dal fatto che Sony piaccia quello che stai facendo.
